Nerokit

1. Purpose

These general terms and conditions govern the sale of automotive parts and accessories concluded on the nerokit.com website between BOISSEAU, sole proprietor (EI) operating the store under the trading name Nerokit, SIREN 929 511 442, 16 place des Quinconces, 33000 Bordeaux, France, contact@nerokit.com, hereinafter “the seller” or “Nerokit,” and any person making a purchase, hereinafter “the customer.” Placing an order implies unreserved acceptance of these terms.

2. Products

The products offered are replacement, styling, and equipment parts intended for vehicles of the brands indicated on each product page. Photographs and illustrations show the product sold: slight differences in color or finish may exist.

Each product page lists the compatible vehicles: by generation and chassis code where the item allows it, otherwise by make or model, with the relevant details in the description. Compatibility is established based on these criteria and not solely on the commercial name of the vehicle: two vehicles sharing the same model name may require different parts depending on their year and production phase.

3. Pricing

Prices are listed in euros. VAT not applicable, article 293 B of the French General Tax Code: the displayed price is the price you pay. Shipping is free: no additional charges are added at checkout. The seller reserves the right to modify prices at any time; the applicable price is the one in effect at the time the order is placed.

4. Orders

The sale is completed when the customer confirms their order and completes payment. A confirmation email summarizing the order is sent to the customer. The seller reserves the right to cancel any order that appears abnormal, including in cases of prior dispute or suspected fraud.

5. Payment

Payment is made when the order is placed, using one of the available methods: bank card (Visa, Mastercard, American Express), Apple Pay, Google Pay, Link, Bancontact, EPS, PayPal or Klarna. With Klarna, payment may be deferred or split under Klarna’s terms, subject to Klarna’s approval. Payment data is transmitted in encrypted form to the payment provider and is never stored by the seller.

6. Shipping

Products are delivered to the address provided by the customer. The estimated delivery window of 7 to 14 days from the date of order is indicated on each product page. This window covers sourcing from the manufacturer and shipping.

In accordance with article L216-1 of the French Consumer Code, the seller commits to delivering within a maximum of thirty days from the date of order, unless otherwise agreed. If this deadline is exceeded, the customer may cancel the sale and receive a full refund.

Upon receipt, the customer is responsible for inspecting the condition of the package and filing any claim with the carrier in the event of visible damage.

7. Right of Withdrawal

The customer has fourteen days from the date of receipt to exercise their right of withdrawal, without needing to provide a reason. Nerokit extends this period to thirty days as a commercial gesture.

The product must be returned complete, in its original packaging, uninstalled, and in resalable condition. A part that has been installed, drilled, painted, cut, or had its protective film removed cannot be accepted for return, as it can no longer be resold.

Return shipping costs are the responsibility of the customer, except when the delivered product is non-conforming, defective, or does not match the stated compatibility: in that case, Nerokit covers the return shipping and refunds the item in full.

The customer may exercise this right by email to contact@nerokit.com or using the withdrawal form in the annex.

The refund is issued within fourteen days of receipt of the returned product, using the same payment method used at the time of the order.

8. Warranties

All products are covered by the statutory conformity warranty (articles L217-3 and following of the French Consumer Code) for two years from the date of delivery, and by the warranty against hidden defects (articles 1641 and following of the French Civil Code).

Under the statutory conformity warranty, the customer may request repair or replacement of the product, or failing that, a price reduction or cancellation of the sale. The customer is not required to provide proof of the defect during the twenty-four months following delivery.

Legal guarantee of conformity: information notice

The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.

The legal guarantee of conformity requires the seller, where applicable, to provide all updates needed to keep the goods in conformity.

It entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the legal guarantee, the consumer benefits from a six-month extension of the initial guarantee. If the consumer asks for a repair but the seller imposes a replacement, the guarantee is renewed for two years from the date of replacement.

The consumer may obtain a price reduction while keeping the goods, or terminate the contract and be fully refunded on return of the goods, if: 1) the seller refuses to repair or replace the goods; 2) the repair or replacement takes place after thirty days; 3) the repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or the cost of installing the repaired or replacement goods; 4) the lack of conformity persists despite the seller’s unsuccessful attempt to remedy it.

The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies immediate price reduction or termination, without first requesting repair or replacement. The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the goods are returned in working order.

These rights result from articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who in bad faith obstructs the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. It entitles the consumer to a price reduction if the goods are kept, or to a full refund on return of the goods.

The warranty does not cover damage resulting from improper installation, abnormal use, modification of the product, or normal wear and tear.

9. Personal Data

The processing of personal data is described in the privacy policy, accessible from the website footer.

10. Disputes

In the event of a dispute, the customer is invited to contact the seller at contact@nerokit.com in order to seek an amicable resolution.

These terms and conditions are governed by French law.
